The Digishots.pl Online Store cares about consumer rights. A consumer cannot waive the rights granted to them in the Consumer Rights Act. Provisions of agreements less favorable to the consumer than the provisions of the Consumer Rights Act are invalid, and the provisions of the Consumer Rights Act apply in their place. Therefore, the provisions of this Regulation are not intended to exclude or limit any consumer rights granted to them under binding provisions of law, and any doubts should be interpreted in favor of the consumer. In the event of any inconsistency between the provisions of this Regulation and the above provisions, the latter shall prevail and shall be applied.

  1. General provisions
    1. The online store available at the internet address https://digishots.pl is operated by Elżbieta Socharska conducting business activity under the name DIGISHOTS entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister competent for economy, having: the address of the place of business and the address for deliveries: ul. Poniatowskiego 17, 05-090 JANKI, NIP 5342051836, REGON 016173076, e-mail address: sklep@digishots.pl, telephone number: (22) 682 88 99.
    2. This Regulation is addressed to consumers using the Online Store.
    3. The data controller of personal data processed in connection with the implementation of the provisions of this Regulation is the Service Provider. Personal data is processed for the purposes, scope, and based on the principles indicated in the Regulations of the Online Store. Providing personal data is voluntary. Each person whose personal data is processed by the Service Provider has the right to access their content and the right to update and correct them.
    4. Definitions:
      1. Business days - weekdays from Monday to Friday excluding statutory holidays
      2. Online store - the online store of the Service Provider available at the internet address: https://digishots.pl
      3. Customer – an adult natural person with full legal capacity, a legal person, or an organizational unit without legal personality, but having legal capacity, making purchases from the Seller directly related to its business or professional activity.
      4. Seller (Service Provider) – Elżbieta Socharska conducting business activity under the name DIGISHOTS entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister competent for economy, having: the address of the place of business and the address for deliveries: ul. Poniatowskiego 17, 05-090 JANKI, NIP 5342051836, REGON 016173076, e-mail address: sklep@digishots.pl, telephone number: (22) 682 88 99
      5. Registration form – a form available in the Online Store enabling the creation of an Account.
      6. Order form – an electronic service, an interactive form available in the Online Store enabling the placement of an Order, in particular by adding Products to the electronic basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
      7. Product – a tangible item available in the Online Store which is the subject of a Sales Agreement between the Customer and the Seller.
      8. Order - the Customer's declaration of intent made using the Order Form and directly aiming to conclude a Sales Agreement of a Product with the Seller.
      9. Electronic payment operator - PayU SA with its registered office in Poznań, 60-166 Poznań, at ul. Grunwaldzka 182, entered into the register of entrepreneurs kept by the District Court in Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000274399, with share capital of 4,000,000 PLN, fully paid-up, having tax identification number NIP: 779-23-08-495, REGON 300523444
      10. Sales Agreement – an agreement for the sale of a Product concluded or to be concluded between the Customer and the Seller through the Online Store.
      11. Electronic Service – a service provided electronically by the Service Provider to the Service Recipient through the Online Store.
      12. Regulations – these regulations of the Online Store.
      13. Consumer Rights Act (Act) – the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).
      14. Civil Code – the Civil Code Act of April 23, 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).
  2. Electronic Services in the Online Store
    1. Technical requirements necessary to cooperate with the ICT system used by the Service Provider:
      1. Internet connection
      2. Web browser or appropriate application
      3. Providing an email address enabling the sending of information regarding order fulfillment.
    2. The Service Recipient is obliged to use the Online Store in accordance with the law and good manners, taking into account respect for personal rights as well as copyrights and intellectual property rights of the Service Provider and third parties. The Service Recipient is obliged to enter data consistent with the factual state. The Service Recipient is prohibited from providing unlawful content.
    3. Complaint handling procedure:
    4. Complaints related to the provision of Electronic Services by the Service Provider and other complaints related to the operation of the Online Store (excluding the Product complaint procedure, which is indicated in points 6 and 7 of the Regulations), the Service Recipient may submit, for example:
      1. In writing to the address: Digishots.pl Online Store, ul. Poniatowskiego 17, 05-090 Janki
      2. Electronically via email to the address: sklep@digishots.pl
    5. It is recommended for the Service Recipient to provide in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of irregularities; (2) the Service Recipient's request; and (3) contact details of the complainant - this will facilitate and expedite the consideration of the complaint by the Service Provider. The requirements given in the previous sentence are recommendations only and do not affect the effectiveness of complaints submitted without the recommended complaint description.
    6. The Service Provider shall respond to the complaint promptly, no later than within 14 calendar days from the date of its submission.
  3. CONDITIONS FOR CONCLUDING A SALES AGREEMENT
    1. The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer submits an Order using the Order Form in the Online Store.
    2. The price of the Product displayed on the Online Store website is in Polish zlotys and includes taxes. The total price including taxes of the Product subject to the Order, as well as the delivery costs (including fees for transport, delivery, and postal services) and other costs, and when the amount of these fees cannot be determined - the obligation to pay them, is communicated to the Customer on the Online Store pages during the Order placement process, including at the moment of expressing the Customer's willingness to be bound by the Sales Agreement.
    3. Procedure for concluding a Sales Agreement in the Online Store using the Order Form
    4. The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer submits an Order in the Online Store.
    5. The content of the Sales Agreement concluded is recorded, secured, and made available to the Customer through (1) making this Regulation available on the Online Store website and (2) sending an email message to the Customer. The content of the Sales Agreement is additionally recorded and secured in the Seller's Online Store IT system.
  4. METHODS AND TERMS OF PAYMENT FOR THE PRODUCT
    1. The Seller provides the Customer with the following payment methods for the Sales Agreement:
      1. Cash on delivery upon receipt of the shipment.
      2. Cash payment upon personal pickup.
      3. Payment by bank transfer to the Seller's bank account.

      4. Electronic payments and card payments via the PAYU.PL service - the currently available payment methods are specified on the Online Store website in the "Payment Methods" tab and on the website http://www.payu.pl.
    2. Settlements of transactions using electronic payments and by card are made according to the Customer's choice through the PAYU.PL service. Electronic payments and card payment services are provided by: PayU S.A. with its registered office in Poznań, 60-166 Poznań, at ul. Grunwaldzka 182, entered into the register of entrepreneurs kept by the District Court in Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000274399, with share capital of 4,000,000 PLN, fully paid-up, having tax identification number NIP: 779-23-08-495, REGON 300523444
    3. Payment deadline:
      1. In the case of the Customer choosing cash payment upon personal pickup, bank transfer, electronic payments, or card payments, the Customer is obliged to make the payment within 7 calendar days from the date of concluding the Sales Agreement.
      2. In the case of the Customer choosing payment on delivery upon receipt of the shipment, the Customer is obliged to make the payment upon receipt of the shipment.
  5. COST, METHODS, AND DELIVERY AND PRODUCT PICKUP SCHEDULE
    1. Product delivery is available within the territory of the Republic of Poland.
    2. Product delivery to the Customer is chargeable unless the Sales Agreement states otherwise. The costs of product delivery (including fees for transportation, delivery, and postal services) are indicated to the Customer on the Internet Store's pages in the "Delivery Costs" tab as well as during the placement of the Order, also at the moment of the Customer's expression of intent to be bound by the Sales Agreement.
    3. Personal pickup of the Product by the Customer is free of charge.
    4. The Seller provides the Customer with the following delivery or pickup methods for the Product:
    5. Postal shipment, cash on delivery postal shipment
    6. Courier shipment, cash on delivery courier shipment.
    7. Personal pickup available at the address: ul. Poniatowskiego 17, 05-090 Janki– on Business Days, from 10:00 to 18:00.
    8. The delivery time of the Product to the Customer is up to 7 Business Days, unless a shorter period is indicated in the description of the given Product or during the placement of the Order. In the case of Products with different delivery times, the delivery time is the longest specified time, but it cannot exceed 7 Business Days. The commencement of the delivery period of the Product to the Customer is counted as follows:
      1. In the case of the Customer's choice of payment by bank transfer, electronic payment, or payment card - from the day of crediting the Seller's bank account or settlement account.
      2. In the case of the Customer's choice of cash on delivery payment method - from the day of concluding the Sales Agreement.
    9. The readiness period of the Product for pickup by the Customer – in the case of the Customer's choice of personal pickup of the Product, the Product will be ready for pickup by the Customer within a period of up to 2 Business Days, unless a shorter period is indicated in the description of the given Product or during the placement of the Order. In the case of Products with different readiness periods for pickup, the readiness period for pickup is the longest specified period, but it cannot exceed 2 Business Days. The Customer will be additionally informed by the Seller about the readiness of the Product for pickup by sending an appropriate email message to the email address provided by the Customer during the placement of the Order. The commencement of the readiness period of the Product for pickup by the Customer is counted as follows:
      1. In the case of the Customer's choice of payment by bank transfer, electronic payment, or payment card - from the day of crediting the Seller's bank account or settlement account.
      2. In the case of the Customer's choice of cash payment upon personal pickup – from the day of concluding the Sales Agreement.
  6. PRODUCT COMPLAINT (APPLIES TO SALES AGREEMENTS CONCLUDED AFTER DECEMBER 25, 2014)
    1. The basis and scope of the Seller's liability towards the Customer if the sold Product has a defect are determined by the generally applicable provisions of law, in particular, the Civil Code.
    2. The Seller is obliged to provide the Customer with a defect-free Product. Detailed information regarding the Seller's liability for the defect of the Product and the Customer's rights is specified on the Internet Store's website in the "Product Complaint" tab.
    3. A complaint can be filed by the Customer, for example:
      1. in writing to the address: Digishots.pl Online Store ul. Poniatowskiego 17, 05-090 Janki;
      2. electronically via email to the address: sklep@digishots.pl;
    4. The Customer is advised to provide in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of the defect; (2) a request for the method of bringing the Product into conformity with the Sales Agreement or a statement of price reduction or withdrawal from the Sales Agreement; and (3) contact details of the complainant – this will facilitate and accelerate the handling of the complaint by the Seller. The requirements specified in the preceding sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended complaint description.
    5. The Seller will respond to the Customer's complaint promptly, no later than within 14 calendar days from the date of its submission. Failure to respond by the Seller within the above period means that the Seller has considered the complaint justified.
    6. In the event that for the Seller to respond to the Customer's complaint or to exercise the Customer's rights arising from warranty, it will be necessary to deliver the Product to the Seller, the Customer will be asked by the Seller to deliver the Product at the Seller's expense to the address of the Digishots.pl Online Store ul. Poniatowskiego 17, 05-090 Janki. If, due to the type of Product or the method of its installation, the delivery of the Product by the Customer would be excessively difficult, the Customer is obliged to make the Product available to the Seller in the place where the Product is located.
  7. EXTRAJUDICIAL METHODS OF COMPLAINT RESOLUTION AND CLAIMS ENFORCEMENT AS WELL AS ACCESS TO THESE PROCEDURES
    1. Detailed information on the possibilities for the consumer Customer to use out-of-court complaint resolution and claims enforcement methods and the rules for accessing these procedures are available at the headquarters and on the websites of district (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection, and at the following internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
    2. The consumer Customer has the following exemplary options for using out-of-court complaint resolution and claims enforcement:
    3. The Customer has the right to apply to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2001 No. 4, item 25, as amended), with a request to settle a dispute arising from the concluded Sales Agreement. The regulations on the organization and operation of permanent amicable consumer courts are specified in the regulation of the Minister of Justice of 25 September 2001 regarding the determination of the regulations on the organization and operation of permanent amicable consumer courts. (Journal of Laws of 2001, No. 113, item 1214).
    4. The Customer has the right to apply to the Voivodship Inspector of Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2001 No. 4, item 25, as amended), with a request to initiate mediation proceedings for the amicable settlement of a dispute between the Customer and the Seller. Information on the rules and procedure of mediation conducted by the Voivodship Inspector of Trade Inspection is available at the headquarters and on the websites of individual Voivodship Inspectorates of Trade Inspection.
    5. The Customer may obtain free assistance in resolving a dispute between the Customer and the Seller, also using the free assistance of the district (city) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Polish Consumer Association). Advice is provided by the Consumer Federation at the toll-free consumer helpline number 800 007 707 and by the Polish Consumer Association at the email address porady@dlakonsumentow.pl.
  8. RIGHT OF WITHDRAWAL (APPLIES TO SALES AGREEMENTS ENTERED INTO AFTER DECEMBER 25, 2014)
    1. A consumer who has entered into a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs, except for the costs specified in point 8.8 of the Regulations. To meet the deadline, it is sufficient to send a statement before its expiry. The declaration of withdrawal from the contract may be made, for example:
      1. in writing to the address: Digishots.pl Online Store ul. Poniatowskiego 17, 05-090 Janki;
      2. electronically via email to the address: sklep@digishots.pl;
    2. A sample withdrawal form is included in Annex 2 to the Consumer Rights Act and is also available on the Internet Store's website in the "Withdrawal from the contract" tab. The consumer may use the withdrawal form template, but this is not obligatory.
    3. The period for withdrawing from the contract begins:
      1. for a contract under which the Seller delivers the Product, being obliged to transfer its ownership (e.g., Sales Agreement) - from the date of taking possession of the Product by the consumer or a third party designated by them, other than the carrier, and in the case of a contract which: (1) covers multiple Products that are delivered separately, in batches or in parts - from the date of taking possession of the last Product, batch or part, or (2) consists of regular delivery of Products for a specified period - from the date of taking possession of the first of the Products;
      2. for other contracts - from the day of concluding the contract.
    4. In the event of withdrawal from a distance contract, the contract is considered void.
    5. The Seller is obliged to immediately, but no later than within 14 calendar days from the day of receiving the consumer's statement of withdrawal from the contract, refund to the consumer all payments made by them, including the cost of delivering the Product (except for additional costs resulting from the consumer's choice of a delivery method other than the cheapest standard delivery method available in the Online Store). The Seller shall make the refund using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not involve any costs for them. If the Seller has not offered to collect the Product from the consumer themselves, they may withhold the refund of payments received from the consumer until they receive the Product back or until the consumer provides proof of returning the Product, whichever occurs first.
    6. The consumer is obliged to immediately, but no later than within 14 calendar days from the date of withdrawal from the contract, return the Product to the Seller or hand it over to a person authorized by the Seller to receive it, unless the Seller has offered to collect the Product themselves. To meet the deadline, it is sufficient to return the Product before its expiry. The consumer may return the Product to the address: Digishots.pl Online Store ul. Poniatowskiego 17, 05-090 Janki;
    7. The consumer is liable for any diminished value of the Product resulting from using it in a way exceeding what is necessary to establish the nature, characteristics, and functioning of the Product.
    8. Possible costs associated with the consumer's withdrawal from the contract that the consumer is required to bear:
      1. If the consumer has chosen a delivery method other than the cheapest standard delivery method available in the Online Store, the Seller is not obliged to refund the consumer for the additional costs incurred by them.
      2. The consumer bears the direct costs of returning the Product.
      3. In the case of a Product which is a service, the performance of which - at the express request of the consumer - began before the expiry of the withdrawal period, the consumer who exercises the right of withdrawal from the contract after making such a request is obliged to pay for the services provided until the withdrawal from the contract. The amount to be paid is calculated proportionally to the scope of the service provided, taking into account the agreed price or remuneration. If the price or remuneration is excessive, the basis for calculating this amount is the market value of the service provided.
    9. The right of withdrawal from a distance contract does not apply to the consumer with regard to contracts:
      1. for the provision of services, if the Seller has fully performed the service with the consumer's express consent, who was informed before the provision of the service that after its performance by the Seller, they will lose the right to withdraw from the contract;
      2. for which the price or remuneration depends on financial market fluctuations over which the Seller has no control and which may occur before the expiry of the withdrawal period;
      3. for the supply of goods made to the consumer's specifications or clearly personalized;
      4. for the supply of goods which are liable to deteriorate or expire rapidly;
      5. for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
      6. for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;
      7. for the supply of alcoholic beverages, the price of which was agreed at the time of concluding the Sales Agreement, but the delivery of which can only take place after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control;
      8. where the consumer has expressly requested the Seller to come to them for urgent repair or maintenance work; if the Seller provides additional services other than those requested by the consumer, or provides goods other than spare parts necessary for the repair or maintenance, the right of withdrawal from the contract applies to the consumer in relation to the additional services or goods;
      9. for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and with the acknowledgment that they will lose their right of withdrawal once the performance has begun;
      10. for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts;
      11. concluded through a public auction;
      12. for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision;
      13. for the supply of digital content which is not stored on a tangible medium if the performance has begun with the consumer's prior express consent and with the acknowledgment that they will lose their right of withdrawal.
  9. PERSONAL DATA IN THE ONLINE STORE
    1. The administrator of personal data of Service Recipients/Clients collected through the Online Store is the Seller.
    2. Personal data of Service Recipients/Clients collected by the administrator through the Online Store are collected - in accordance with the Service Recipient/Client's consent - for the purpose of performing the Sales Agreement or the agreement for the provision of Electronic Services .
    3. Possible recipients of personal data of Online Store Clients:
      1. In the case of a Client who uses postal or courier delivery in the Online Store, the Administrator makes the collected personal data of the Client available to the selected carrier or intermediary carrying out shipments on behalf of the Administrator.
      2. In the case of a Client who uses electronic payments or payment card in the Online Store, the Administrator makes the collected personal data of the Client available to the selected entity servicing the above payments in the Online Store.
    4. The Service Recipient/Client has the right to access their data and correct it. A request in this regard may be submitted, for example:
      1. in writing to the address: Digishots.pl Online Store ul. Poniatowskiego 17, 05-090 Janki;
      2. electronically via email to the address: sklep@digishots.pl
    5. Providing personal data is voluntary, however, failure to provide the personal data specified in the Regulations necessary to conclude the Sales Agreement or the agreement for the provision of Electronic Services results in the inability to conclude the said agreement. The data necessary to conclude the Sales Agreement or the agreement for the provision of Electronic Services are also indicated each time on the Online Store's website before concluding the relevant agreement.
  10. FINAL PROVISIONS
    1. Agreements concluded through the Online Store are concluded in Polish.
    2. Amendment of the Regulations:
      1. The Service Provider reserves the right to amend the Regulations for valid reasons, i.e., changes in legal regulations; changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations.
      2. In the event of concluding, based on these Regulations, agreements of a continuous nature (e.g., provision of an Electronic Service - Account), the amended regulations are binding on the Service Recipient if the requirements specified in art. 384 and 384[1] of the Civil Code have been met, i.e., the Service Recipient has been properly notified of the changes and has not terminated the agreement within 14 calendar days from the date of notification. In the event that the amendment to the Regulations results in the introduction of any new fees or an increase in the current ones, the consumer who is a Service Recipient has the right to withdraw from the agreement.
      3. In the case of concluding agreements based on these Regulations of a different nature than continuous agreements (e.g., Sales Agreement), changes to the Regulations shall not in any way affect the acquired rights of Service Recipients/Clients who are consumers before the date of entry into force of the amendments to the Regulations, in particular, changes to the Regulations shall not affect orders already placed or contracts concluded, implemented or executed Sales Agreements.
      4. Matters not regulated in these Regulations shall be governed by the generally applicable provisions of Polish law, in particular: the Civil Code; the Act on the provision of electronic services of July 18, 2002 (Journal of Laws of 2002 No. 144, item 1204, as amended); for Sales Agreements concluded after December 25, 2014, with consumers - the provisions of the consumer rights act of May 30, 2014 (Journal of Laws of 2014, item 827, as amended); and other relevant provisions of generally applicable law.
